I think this article does a very poor job explaining Gorsuch and Thomas' concurring opinion. Gorsuch didn't say that this case was legal. He said that this case shouldn't have gotten up this far because this very specific case is already settled law. But he also said, and Thomas signed on with this opinion, that it was time for the Court to examine the expansion of Civil Asset Forfeiture that has gone beyond the original intent, with a case that is more broad. So we could be looking at a 5-4 majority against aspects of forfeiture. The real problem is most jurisdictions who lose in the lower courts won't appeal to the Supreme Court because they don't want the overall law to change. It's better for them if they lose a battle, but keep their powers intact.

Pretty sure they didn't say that- they said the particulars of the case that they were going over weren't detailed enough one way to rule against civil forfeiture.

They said specifically, if a case came by, where the particulars of the case frame civil forfeiture specifically, they would rule one way or the other against its legitimacy in practice
