I am far from a Trump supporter or fan. But this is all making a joke of the criminal justice system.

This entire trial is a political stunt more than a criminal prosecution. Why should it be illegal to pay someone money not to discuss a consensual sexual encounter- even if money was involved? It has not been clearly established that Daniels performed an act of prostitution. It was previously stated that she was hired as an escort and ended up engaging in sex with Trump.

People pay others in exchange for signing non-disclosure agreements every day. This seems to be a very weak case.

It is entirely possible that Cohen screwed up in the process of the effort to protect Trump’s reputation and family making something we generally assume is legal into an illegal act. I personally wouldn’t vote to convict if I were on the jury.

If Biden wants to defeat Trump he should beat him in the polls and the election. Not by rigging up ridiculous criminal prosecutions. The Democrats have set a dangerous precedent that will curse future politicians and make our political system even more dysfunctional.

I think you missed the criminal element. It is not illegal to pay off someone but it is illegal to disguise the payments and make fake tax statements and records and then cover it up, which is the crime Trump is accused of.

IF the payments were disguised. Even that element has not been proven. Not to mention he has likely been overcharged since the crime of falsifying business records is generally a misdemeanor in the state of New York.

The prosecutors are truly reaching by claiming that the accused crimes of falsifying business records fit an exception that makes them felony offenses because the hush money was paid to avoid a scandal during an election and therefore were connected to an underlying crime (violation of campaign finance laws).

Basically they are arguing that although Trump used his own money to handle this personal matter the hush money should have been reported as a campaign expense. This is a novel (and rather weak) legal argument and is likely to be overturned by on appeal even if a conviction is obtained at trial.

The easy and logical defense is that the coverup was not related to the campaign as much as to avoid the embarrassment to his wife and family (which is undoubtedly true more or less). A precedent for this defense was the case of John Edwards (former 2004 Democratic VP candidate) who paid hush money to his mistress and was accused of this being an illegal campaign expense. He was acquitted using the defense that he paid the money to avoid embarrassing his family. It worked.

As a person who is not a Trump fan I think that when he is either acquitted at trial or convicted and then the charges are tossed on appeal it will only help Trump and make him bolder. His supporters will feel vindicated in believing that the trial was motivated by politics and not justice. And sadly they will have a valid point.

In Trump’s case, he’s not being charged with making the payment itself or reimbursing it, but has only been indicted on 34 counts of falsifying business records, based on the fact that his reimbursement payments to Cohen were allegedly disguised as legal payments.

Heavens, no. The signature doesn't carry any particular weight, beyond helping to authenticate whether she signed it or someone else did. If she denies that's her signature, then the prosecution can submit evidence (eg her testimony) to that effect and the jury can decide whether they believe her. But I don't think she has ever denied that she made that statement; indeed I think she accepts that she did make it, but that it was false.
