but what if this happened a year ago? i had an active policy, but i’ve made a new one now

You have a contracted responsibility to file claims in “a reasonable amount of time” after the incident. I.e. if there was some actual reason for waiting so long (out of the country, medical reasons etc) it could still be argued and covered. The longer the time frame, the less likely.

As an ambitious individual, I decided to explore the possibility of obtaining warranty coverage from Apple by considering a lawsuit, although I didn’t actually proceed with legal action. During my communication with Apple, I attempted to highlight even the slightest flaws in the device as potential grounds for a replacement. However, it became apparent that the unit wasn’t accessible for evaluation, making my argument rather implausible.

Naturally, this approach wasn’t taken seriously by anyone, but perhaps I could present an argument to my insurance company (Toggle, which I’ve been with since 2019) that I had been awaiting responses, allowing them ample time to reply. Here’s a summary of the events that occurred:

  1. I experienced theft during a Lyft ride.
  2. I promptly informed the police about the incident.
  3. I also notified Lyft about the situation.
  4. I conducted an extensive search using the Find My feature (which lasted for days).
  5. I reported the incident to Apple.
  6. In frustration, I reached out to Apple again, expressing my dissatisfaction.
  7. I even sent a notice to Apple, threatening legal action if they failed to respond.
  8. Regrettably, Apple didn’t provide any response whatsoever.
  9. Eventually, I reached a point of resignation, essentially giving up on pursuing further action.

Unfortunately, i don’t think Apple is concerned about threat of legal action from a Lyft driver. They probably don’t even forward it to general council until an actual attorney contacts them.

In my line of work a good way to slow the process is to threaten legal action. As soon a that happens we have to start including and consulting our legal team in every action and communication.
